1. Introduction
These Terms of Use (“Terms”) govern your access to and use of the Sous mobile application and related services (collectively, the “App”), provided by Gonçalo Regalado Unipessoal, Lda, a company incorporated in Portugal (“Sous”, “we”, “us”, “our”).
By downloading, installing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
You must be at least 18 years old (or the age of majority in your country) to use Sous. If you are between 13 and 18, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Sous is not intended for children under 13.
3. Account & Access
You may create an account or sign in using a third-party provider (such as Apple or Google). You are responsible for:
- maintaining the confidentiality of your credentials
- all activity that occurs under your account
Notify us promptly at [email protected] of any unauthorized use.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
4. Subscriptions, Billing & Renewal
Sous may offer a free tier and a paid “Plus” tier with different usage limits and features. Pricing, inclusions, and limits are shown in-app at the time of purchase.
- Subscriptions are billed through the Apple App Store and/or Google Play using your store account.
- Subscriptions automatically renew for the same period unless you cancel at least 24 hours before the current period ends.
- You can manage or cancel your subscription at any time through your App Store / Google Play account settings.
- We do not process or store full payment card details; payments are handled by the relevant store provider.
- To the maximum extent allowed by the stores’ rules and applicable law, all fees are non-refundable once the subscription period begins, except where a refund is required by law or expressly offered by the store.
5. Fair Use & Usage Limits
Plans may include monthly limits on recipe generations or other features. We may apply reasonable technical limits and fair-use safeguards to prevent abuse, automated use, or usage that negatively affects service stability.
We reserve the right to:
- restrict or throttle usage that appears abusive or inconsistent with personal use
- suspend or terminate accounts that circumvent or attempt to circumvent usage limits
6. User Content
“User Content” includes text you input into Sous (for example ingredients, notes, preferences) and any content generated for you by the App (for example recipes, instructions).
You retain any rights you have in your User Content. By using the App, you grant Sous a worldwide, non-exclusive, royalty-free license to store, process, and use your User Content solely:
- to provide and improve the App
- to generate recipes and related content for you
- to maintain backups and logs
You are responsible for ensuring your User Content:
- does not infringe third-party rights
- does not include unlawful, harmful, or offensive material
We may remove or restrict access to User Content that violates these Terms or applicable law.
7. Acceptable Use
You agree not to:
- use Sous for any unlawful purpose
- attempt to reverse engineer, decompile, or otherwise access the App’s source code
- use automation, bots, or scraping to access, query, or extract content
- interfere with or impair the App’s operation or security
- resell or commercially exploit Sous or the content generated for you, except for normal personal/home cooking use
We may suspend or terminate your account for violation of this section.
8. Third-Party Services & AI Models
Sous uses third-party services, including AI model providers, analytics services, authentication providers, and hosting providers, to deliver core functionality. When you request a recipe, we may send your prompts and context (such as ingredients, dietary preferences, and robot model) to third-party AI APIs to generate content, as described in the Privacy Policy.
We are not responsible for the availability or performance of third-party services, which may be subject to their own terms.
9. Intellectual Property
The App, including its design, text, graphics, logos, code, and other content (excluding User Content), is owned by Sous or its licensors and is protected by copyright and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code, except as permitted by law.
Sous is not affiliated with Thermomix®, Bimby®, Monsieur Cuisine®, or any other robot brand unless explicitly stated.
10. No Nutritional, Medical, or Safety Advice
Sous generates recipes and cooking instructions using AI and other automated systems. These outputs may be incomplete, inaccurate, or unsafe if followed without judgment and are provided for informational purposes only.
Sous does not provide professional nutritional, medical, or food-safety advice. You are responsible for:
- checking ingredients and allergens
- ensuring food is properly cooked
- using your appliances safely and following manufacturer instructions
Sous is not liable for issues arising from improper food handling or appliance use.
11. Disclaimers
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
We do not warrant that the App will be uninterrupted, error-free, or secure, or that generated recipes will meet your expectations.
12. Limitation of Liability
To the maximum extent permitted by law, Sous and its owners, directors, employees, and partners shall not be liable for:
- any indirect, incidental, special, consequential, or punitive damages
- any loss of profits, revenue, data, or goodwill
- any damages arising from or related to your use of the App, recipes, or instructions
Where liability cannot be excluded, our total aggregate liability shall not exceed the amount you paid to Sous in the previous 12 months.
13. Indemnity
You agree to indemnify and hold harmless Sous and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your:
- use of the App
- violation of these Terms
- infringement of any third-party rights
14. Changes to the App and Terms
We may modify or discontinue parts of the App at any time. We may also update these Terms from time to time. When we do, we will update the “Last updated” date and, where required by law, notify you in-app or by email.
If you continue using the App after the updated Terms take effect, you agree to the changes.
15. Termination
You may stop using Sous at any time. We may suspend or terminate your access to the App if you:
- materially breach these Terms
- misuse or abuse the service
- we are required by law or by a third-party provider to do so
Termination will not relieve you of any obligations incurred before the termination date.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles.
If you are a consumer resident in the EU/EEA or UK, mandatory consumer protection rules of your country of residence still apply and you may have the right to bring proceedings in your local courts.
